Terms of Service

These Terms of Service ("Terms") are an agreement between you (and, if you're signing up on behalf of a company, that company) and GrowthAI ("GrowthAI," "we," "us") governing your access to and use of the GrowthAI website, application, and related services (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What GrowthAI is

GrowthAI is a sales prospecting and CRM platform for small business teams. Depending on what's enabled for your account, the Service may let you:

• Search for prospective business contacts using criteria you provide (industry, location, company size, decision-maker title, and similar filters);
• Import your own prospect lists by uploading a spreadsheet or pasting text, including profile snippets you've copied from other sites;
• Store, organize, score, and track prospects in a private sales pipeline;
• Generate draft outreach content (such as emails or call openers) and a draft growth plan based on information you provide and data already in your workspace;
• Optionally verify or enrich contact records using third-party data services;
• Invite teammates to a shared organization workspace with role-based permissions;
• Subscribe to a paid plan through our payment processor.

Lead search results, AI-drafted outreach content, and growth plan suggestions are starting points, not verified facts or professional advice. You're responsible for reviewing, verifying, and editing anything GrowthAI generates or surfaces before you rely on it or send it to anyone — see Section 6.

2. Accounts and eligibility

You must provide accurate information when you create an account and keep it up to date. You're responsible for everything that happens under your account and for keeping your login credentials confidential, including any multi-factor authentication method you set up. Tell us right away if you suspect unauthorized access to your account.

You must be at least 18 years old and able to form a binding contract to use the Service. If you create an account on behalf of a company, you're confirming you have authority to bind that company to these Terms.

3. Organizations, teams, and roles

An account belongs to an organization workspace. The first person to sign up for an organization is its administrator by default. Administrators can invite teammates, assign roles, assign leads, and see activity across the workspace. If you're invited to someone else's organization, that organization's administrator controls your access and can remove it at any time. We are not responsible for disputes between members of the same organization over data ownership or access.

4. Your data and content

You retain ownership of the prospect data, notes, company information, and other content you upload, import, paste, or otherwise add to the Service ("Your Content"). You grant GrowthAI a limited license to host, process, and display Your Content solely to provide and improve the Service for you and your organization.

You're responsible for making sure you have the right to upload and use any contact data you add to GrowthAI, and for complying with applicable laws — including marketing, telemarketing, and data protection laws — when you contact the people in your pipeline. GrowthAI is a tool for organizing outreach; it is not a substitute for your own legal compliance review.

5. Acceptable use

You agree not to:

• Use the Service to send spam, unlawful marketing, or content that violates applicable anti-spam, telemarketing, or data protection laws;
• Upload data you don't have the right to use, or that infringes someone else's rights;
• Attempt to access another organization's workspace or data without authorization;
• Reverse engineer, scrape at scale, or attempt to extract the Service's underlying software or data systems;
• Use the Service to build a competing product;
• Interfere with the Service's normal operation or attempt to bypass its security or rate limits.

We may suspend or terminate accounts that violate this section.

6. No guarantee of accuracy

Lead search results draw on third-party business data sources, and imported or pasted data comes from you. Neither source is guaranteed to be current, complete, or accurate. AI-drafted outreach content and growth plans are generated from the information available in your workspace and may contain errors or assumptions that don't fit your situation. GrowthAI does not verify that any contact, company, or outreach draft is accurate, deliverable, or appropriate to send — that review is on you before you act on it.

7. Subscriptions and billing

Some features require a paid subscription. Paid subscriptions are billed through Stripe, our payment processor; we don't store your full card number. By subscribing, you authorize recurring charges at the then-current price until you cancel. You can view your billing status and manage your subscription from your Account page. Fees are non-refundable except where required by law or as we separately agree in writing.

We may change pricing going forward; we'll give you reasonable notice before a price change takes effect for your next billing cycle.

8. Third-party services

Some GrowthAI features rely on third-party providers — for example, services that search public business listings, verify email deliverability, enrich contact records, send transactional email, or process payments. Your use of those features is also subject to those providers' terms where applicable. We don't control and aren't responsible for third-party services' accuracy, availability, or practices.

9. Suspension and termination

You can stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service, with notice where reasonably practical. Sections that by their nature should survive termination (including Sections 4, 6, 10, and 11) will survive.

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY LEAD, CONTACT DETAIL, OR AI-GENERATED CONTENT WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWTHAI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

11. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll update the date at the top of this page and, where appropriate, notify you through the Service or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
